Terms of Use

1. The service

Lex is a language-learning app that lets you capture words from your surroundings, learn vocabulary through a word game, review with spaced repetition, and practice with an AI tutor. Features may change, improve, or be discontinued over time.

2. Eligibility & age

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Lex. By using the app you confirm you meet this requirement.

3. Your account

• Lex creates an anonymous account automatically — no sign-up is required.
• You may optionally link Sign in with Apple to preserve your library across devices.
• You are responsible for activity that occurs through your account and device.

4. Subscriptions & payments

• Lex offers Lex Pro, an auto-renewable subscription (e.g., weekly or yearly plans), and may offer a free trial.
• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in iOS Settings → your Apple ID → Subscriptions.
• Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• All purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple according to its policies.

5. Your content & license

• You own the content you create (the photos you capture, words you save, and your chat input).
• You grant us a limited, worldwide, non-exclusive license to host, store, process, and display this content solely to operate and provide the app to you (including syncing across your devices and sending necessary data to our AI provider, as described in our Privacy Policy).
• You are responsible for the content you capture and submit, and you confirm you have the right to use it.

6. Acceptable use

You agree not to:

• Use Lex for any unlawful purpose or to capture content that infringes others' rights or privacy.
• Upload illegal, harmful, hateful, or abusive content.
• Attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the app or our servers.
• Misuse the AI features to generate prohibited or harmful content.

We may suspend or terminate access if you violate these Terms.

7. AI-generated content

• Lex uses AI to suggest words, definitions, examples, and tutoring content. AI output may be inaccurate or incomplete.
• AI content is provided for educational purposes only and is not professional, legal, medical, or certified linguistic advice. Verify important information independently.

8. Intellectual property

The app, its design, mascot ("Lex"), branding, and software are owned by the Developer and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Third-party services

Lex relies on third-party services (including Supabase, Adapty, OpenRouter, and Apple). Your use of the app may be subject to those parties' terms, and we are not responsible for their services.

10. Disclaimers

The app is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that learning outcomes are guaranteed.

11. Limitation of liability

To the maximum extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data or profits, arising from your use of the app. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.

12. Termination

You may stop using Lex at any time and delete your account from within the app. We may suspend or terminate your access if you breach these Terms or if required by law.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules.

14. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide notice in the app. Continued use after changes means you accept the updated Terms.

15. Apple-specific terms

• These Terms are between you and the Developer only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
